Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kardra ("we," "us," "our"), including our website, iOS app, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

We may update these Terms from time to time. We will update the "Last updated" date above. Continued use after changes take effect constitutes acceptance. If you disagree with an update, stop using the Service and close your account.

You must be at least 13 years old to use the Service. By using it, you confirm you meet this requirement. If you use the Service on behalf of an organization, you represent you have authority to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Contact us at getkardra@gmail.com if you suspect unauthorized access.

Kardra provides tools to:

• Identify trading cards using AI-assisted image analysis
• View estimated condition grades and grading ROI insights
• Access market pricing data derived from third-party sources, including eBay sold listing data
• Track and manage personal card collections

a) AI outputs. Card identification, grade estimates, and pricing data are generated using AI models and third-party data sources. Outputs are informational only. We do not guarantee accuracy, completeness, or timeliness.

b) Not professional advice. Nothing in the Service is professional grading, authentication, financial, investment, legal, or tax advice. Do not treat Kardra as a substitute for professional grading services (PSA, BGS, CGC, or others).

c) Market data. Prices are estimates from third-party data and may lag or differ from current market conditions. We are not affiliated with eBay or other marketplaces unless explicitly stated.

d) Assumption of risk. You use the Service and any information it provides at your own risk.

e) Availability and plan differences. Features and limits may differ between Free and Pro plans. We may modify, suspend, or discontinue parts of the Service at any time, with reasonable notice where practicable.

• You also agree to any applicable Apple terms for your use of apps from the App Store.
• Apple is not responsible for the Service, support, maintenance, or claims related to the app to the maximum extent permitted by law.
• You must comply with applicable third-party terms while using the app.
• You acknowledge that this agreement is between you and Kardra, not Apple.

Free tier

We offer a Free tier with limited features. Limits may change with reasonable notice.

Kardra Pro

Pro is offered as an auto-renewing subscription.

• If purchased on web, billing is processed by Stripe.
• If purchased in iOS, billing is processed by Apple via your App Store account.

Renewals and cancellation

• Subscriptions renew automatically unless canceled before renewal.
• iOS subscriptions must be managed/canceled through Apple account subscription settings.
• Web subscriptions can be managed through your Kardra billing settings.
• Cancellation takes effect at the end of the current billing period unless required otherwise by law.

Pricing and taxes

• Prices shown at checkout include or exclude taxes as required by law and store policy.
• We may change pricing with reasonable advance notice where practicable.

Refunds

• iOS purchases are generally handled by Apple under Apple refund policies.
• Web purchases are handled under Kardra policies and applicable law.

You may upload card images and other content ("User Content"). You retain ownership of your User Content.

You grant us a non-exclusive, worldwide, royalty-free license to host, process, display, and use User Content solely to operate, maintain, secure, and improve the Service.

You represent that:

• You own or have rights to the content you upload
• Your content does not infringe third-party rights
• Your content complies with applicable law

Do not upload unlawful, infringing, harmful, or abusive content.

You agree not to:

• Reverse engineer, scrape, or overload the Service
• Circumvent access controls, usage limits, or payment requirements
• Use the Service to harass, defraud, or harm others
• Upload content that infringes privacy or intellectual property rights
• Use unauthorized automation against the Service
• Resell or redistribute access to the Service
• Attempt unauthorized access to accounts, systems, or data

The Kardra name, logo, software, and original product design are our intellectual property. You may not use our brand assets without permission.

Trading card names, artwork, and game content remain the property of their respective rights holders. We claim no ownership over third-party card content.

The Service integrates with third parties (authentication providers, hosting, AI services, analytics, payment processors, and card/market data providers). Use of those services may be subject to their own terms and privacy policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARDRA AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSSES FROM DECISIONS BASED ON THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Kardra and its affiliates from claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your misuse of the Service, or your breach of these Terms.

You may stop using the Service at any time and close your account. We may suspend or terminate access for material breach, non-payment, abuse, legal requirements, or security risk.

Sections that by nature survive termination will survive.

If you request account deletion, we process deletion of account-linked data in line with our Privacy Policy. Certain records may be retained where required for legal compliance, fraud prevention, dispute handling, or security.

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles, unless your local law requires otherwise.

Disputes will be resolved in courts located in California, subject to mandatory consumer protections in your jurisdiction.

These Terms plus the Privacy Policy are the entire agreement regarding the Service. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.

We may provide notices by posting updates in the Service or by email to the address associated with your account.
